These Terms and Conditions set out the basis on which Waste Clearance Westminster provides waste removal and related services to residential and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any waste collection or clearance work.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, organisation or other entity that requests or receives services from Waste Clearance Westminster.
Services means waste clearance, rubbish removal, bulky waste collection, recycling and any associated services agreed between the Customer and Waste Clearance Westminster.
Waste means any materials, items, goods, refuse or rubbish that the Customer asks Waste Clearance Westminster to remove, transport or dispose of as part of the Services.
Contract means the agreement between the Customer and Waste Clearance Westminster incorporating these Terms and Conditions and any written quotation or booking confirmation.
Waste Clearance Westminster provides waste collection and clearance services for domestic and commercial properties. The exact scope of the Services, including the type and approximate volume of Waste to be removed, the collection location, and any special requirements, will be agreed at the time of booking.
All Services are subject to availability and may be restricted by access, safety conditions, vehicle limitations and the nature of the Waste. Waste Clearance Westminster reserves the right to refuse to handle any materials that are prohibited by law, unsafe, or unsuitable for standard collection.
3.1 Booking methods
Customers may request a booking by telephone or other contact methods as may be made available from time to time. When making a booking request, the Customer must provide accurate information, including:
The collection address and contact details.
A description of the Waste, including type and approximate volume or weight.
Any access issues, parking restrictions, or special circumstances that may affect the Services.
3.2 Quotations and estimates
Any quotation or estimate provided before the collection is based on the information supplied by the Customer. It is the Customer’s responsibility to ensure that information is accurate and complete. Quotations are typically given based on estimated volume, weight, labour and disposal costs, and may change if the actual Waste differs from the description provided.
Waste Clearance Westminster reserves the right to revise the price if on arrival the Waste is substantially more than described, includes items not previously disclosed, or if access and loading conditions materially differ from those stated at the time of booking.
3.3 Confirmation of booking
A booking is not confirmed until Waste Clearance Westminster has accepted the order and provided a booking confirmation, which may be given verbally, by message, or in writing. The Contract is formed when the Customer receives that confirmation. Waste Clearance Westminster reserves the right to decline any booking request at its discretion.
The Customer is responsible for ensuring that:
The Waste to be collected is clearly identified and accessible at the agreed time.
Access to the property is safe, lawful and suitable for the collection team and vehicles, including any necessary parking permissions.
No hazardous, restricted or prohibited items are included in the Waste, unless specifically agreed in advance in writing and lawful arrangements have been made for their handling.
The information provided at the time of booking remains accurate. Any material change must be communicated to Waste Clearance Westminster as soon as possible.
If the collection requires access through shared or third party property, the Customer must obtain all necessary permissions prior to the visit.
5.1 Pricing
Prices for Services are generally based on a combination of factors including volume of Waste, weight where relevant, labour time, accessibility, and disposal or recycling costs. Any price quoted before the collection is an estimate and may be adjusted once the team has inspected the Waste and access conditions.
5.2 Payment terms
Unless otherwise agreed in writing, payment is due in full upon completion of the Services on the day of collection. Waste Clearance Westminster may request a deposit or upfront payment for certain bookings, especially larger commercial projects, early or late hours collections, or repeat contractual arrangements.
Accepted methods of payment may include cash, card payment, bank transfer or other methods notified to the Customer at the time of booking. The Customer agrees to pay all amounts due promptly and in full.
5.3 Late payment
If payment is not received when due, Waste Clearance Westminster reserves the right to charge reasonable interest and administrative fees for late payment. For business Customers, statutory interest and recovery costs may be applied in accordance with applicable UK legislation. Waste Clearance Westminster may also suspend or cancel further Services until all outstanding sums are settled.
6.1 Customer cancellations
The Customer may cancel a booking by giving notice to Waste Clearance Westminster. If cancellation is made at least 24 hours before the agreed collection time, no cancellation fee will usually apply. Cancellations made with less than 24 hours notice may incur a cancellation charge to cover costs and loss of opportunity.
Where a deposit has been paid, Waste Clearance Westminster may retain part or all of the deposit if the booking is cancelled late or if costs have already been incurred that cannot be recovered.
6.2 Rescheduling
Customers may request to reschedule a collection, subject to availability. Waste Clearance Westminster will make reasonable efforts to accommodate the new time or date, but cannot guarantee that all requests will be met. Short notice rescheduling may be treated as a cancellation and rebooking at the company’s discretion.
6.3 Failed collections and waiting time
If the Waste cannot be collected at the agreed time due to the Customer’s acts or omissions, including but not limited to lack of access, parking refusal, incorrect address, or Waste not being available, Waste Clearance Westminster may charge a call-out fee and any applicable waiting time.
Waiting time beyond a reasonable initial period may also be chargeable, particularly in dense urban areas where delays affect scheduling and operating costs.
7.1 General waste
Waste Clearance Westminster ordinarily collects general household and commercial waste, bulky items, furniture, appliances, garden waste and similar materials, subject to applicable regulations and safe handling practices.
7.2 Hazardous and restricted waste
Certain types of Waste are hazardous or are subject to special controls. These may include but are not limited to: chemicals, solvents, paints, oils, asbestos, medical waste, pressurised containers, gas bottles, tyres, and electrical equipment containing hazardous components.
Such materials may only be collected if expressly agreed in advance, and may be subject to additional charges and specific documentation. Waste Clearance Westminster reserves the right to refuse any items that are unsafe, unlawful to handle, or not covered by the company’s licences or permits.
7.3 Ownership and title
By presenting Waste for collection, the Customer warrants that they are the lawful owner of the items or have the full authority of the owner to arrange their removal. Ownership of the Waste transfers to Waste Clearance Westminster at the point of collection, subject to compliance with applicable law and any exceptional arrangements agreed in writing.
Waste Clearance Westminster operates in accordance with relevant UK waste management legislation and guidance. The company will only dispose of or recycle Waste at authorised facilities, using appropriate documentation where required.
The Customer agrees not to request any service that would breach applicable waste, environmental or transport regulations. If the Customer provides false information about the nature of the Waste or instructs Waste Clearance Westminster to perform any unlawful act, the company may immediately terminate the Contract and may report the matter to the relevant authorities.
The Customer must ensure that the collection team has suitable and safe access to the Waste. This includes arranging any parking permits, entry codes, gate keys or other access measures.
While reasonable care will be taken when carrying out the Services, the Customer acknowledges that moving heavy or bulky items, especially in confined spaces, may pose a risk of minor damage to floors, walls, fixtures or fittings. The Customer is responsible for taking any necessary precautions, such as protecting surfaces or removing fragile items from the vicinity of the work area.
Waste Clearance Westminster will not be liable for normal wear and tear or for damage that arises from pre-existing structural weakness, poor condition of property or fixtures, or inadequate preparation by the Customer. Any claim for damage must be notified to Waste Clearance Westminster as soon as reasonably practicable and within a reasonable time after completion of the Services.
10.1 General liability
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
Subject to the above, Waste Clearance Westminster will not be liable for:
Any indirect, consequential or purely economic loss.
Loss of profit, business, revenue, goodwill or anticipated savings.
Any loss arising from events beyond the company’s reasonable control, including traffic delays, severe weather, or public authority restrictions.
10.2 Maximum liability
To the fullest extent permitted by law, the total liability of Waste Clearance Westminster to the Customer in respect of any claim arising out of or in connection with the Contract shall be limited to the total price paid or payable for the specific Services giving rise to that claim.
10.3 Indemnity
The Customer agrees to indemnify Waste Clearance Westminster against any loss, liability, cost or expense arising from a breach by the Customer of these Terms and Conditions or from any unlawful or unsafe instructions given by the Customer regarding the handling of Waste.
Waste Clearance Westminster will make reasonable efforts to attend at the agreed time, but collection times are approximate and may be affected by traffic conditions, vehicle issues, staff availability or other operational factors.
The company will not be liable for any delay or failure to perform the Services where such delay or failure is caused by events beyond its reasonable control, including but not limited to accidents, extreme weather, road closures, public emergencies, strikes or legal restrictions.
If the Customer is dissatisfied with any aspect of the Services, they should raise the matter with Waste Clearance Westminster as soon as possible, providing full details of the issue. The company will investigate the complaint and aim to respond within a reasonable timeframe.
Both parties agree to act in good faith to resolve any dispute. If a dispute cannot be resolved informally, either party may seek advice or assistance from external bodies or pursue any legal rights available under UK law.
Waste Clearance Westminster collects and processes personal data, such as contact details and service information, for the purpose of providing and managing the Services, handling payments, and fulfilling legal obligations.
The company will handle personal data in accordance with applicable data protection legislation in the United Kingdom. Personal data will not be sold to third parties and will only be shared where necessary for service delivery, legal compliance or enforcement of these Terms and Conditions.
Waste Clearance Westminster may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the updated terms have been made available. For ongoing or long-term arrangements, reasonable notice of any material changes will be provided where practicable.
No variation to these Terms and Conditions will be binding unless confirmed in writing by an authorised representative of Waste Clearance Westminster.
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
By making a booking or instructing Waste Clearance Westminster to carry out any waste collection or clearance work, the Customer confirms that they have read, understood and agree to these Terms and Conditions.
